Client Engagement Terms
Scope of Services
The Design Project & Co provides renovation-support and design consultancy services, including guidance from concept to handover. Our role is advisory; we do not act as the builder or take on builder-licence responsibilities.
Engagement Process
Services commence once a written proposal is accepted via email and any required retainer or deposit is paid. The proposal outlines scope, deliverables, timelines, and fees.
Client Responsibilities
You agree to:
- Provide accurate and timely information.
- Make decisions within reasonable timeframes.
- Obtain any required approvals, insurances, or consents unless otherwise stated.
- Communicate respectfully and in good faith.
Fees and Payments
Invoices are issued via Xero and payable within 7 days unless otherwise agreed. Late payments may incur an administrative fee. Services may pause until payment is received.
Variations and Scope Changes
If the scope changes or additional services are requested, we will provide a revised quote or variation for approval before proceeding.
Intellectual Property
Design concepts, documents, or digital products remain our property until full payment is received. Once paid, you receive a licence to use materials for your personal renovation project only.
Confidentiality
We treat all client information as confidential and will not disclose it except as required by law or agreed by you.
Limitation of Liability
Our liability is limited, to the extent permitted by law, to resupplying the services or refunding the service fee. We are not liable for builder performance, third-party actions, or project outcomes.
Termination
Either party may terminate the agreement with written notice if the other breaches material terms and fails to remedy within 14 days. You will be invoiced for all work completed to the termination date.
Governing Law
These terms are governed by the laws of New South Wales, Australia.
